Secret Garden Collectibles is a trading name of Giulia Pavan, sole trader operating in England, United Kingdom (“we”, “us”, “our”).

We operate this website and online store (the “Services”) to provide collectible products intended for individuals aged 15 years and over. Our store is powered by Shopify.

These Terms of Service (“Terms”) govern your access to and use of our Services.

Nothing in these Terms affects your statutory rights under applicable UK consumer protection laws, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

1. ELIGIBILITY

By using our Services, you confirm that:

2. PRODUCT NATURE AND AGE RESTRICTION

We sell collectible items intended for individuals aged 15 years and over.

Our products:

Are collectibles
Are not toys
Are not intended for children under 15 years of age
May contain small parts
May present choking hazards

Adult supervision is recommended where appropriate.

We accept no liability for misuse of products or use contrary to age recommendations.

3. PACKAGING & QUALITY INFORMATION

To identify specific characters or product variations, the outer box may be carefully opened from the top or bottom.

In most cases, the plush or item remains sealed inside the original internal foil or protective packaging. However, in some instances, the internal packaging may be opened strictly for one of the following purposes:

Character verification
Product photography
Random quality control inspection

Packaging is opened only when reasonably necessary for confirmation or inspection purposes.

All items sold are new and handled with care. Any opened packaging is solely for verification or inspection and does not indicate prior use.

Please note:

Outer boxes may show minor transit, handling, or shelf marks due to shipping and storage.
Such minor packaging imperfections do not affect the item inside.
Minor cosmetic variations in packaging are not considered defects.

By purchasing from us, you acknowledge and accept that packaging may have been opened for the limited purposes described above.

4. PRODUCT INFORMATION AND VARIATIONS

We make every effort to display products accurately. However:

Colours may vary depending on device screens
Minor manufacturing variations may occur
Slight differences in finish, texture, or packaging may occur

Minor variations that do not affect functionality or overall appearance are not considered defects.

5. ORDERS AND ACCEPTANCE

Placing an order constitutes an offer to purchase.

A binding contract is formed only when we send an order confirmation email.

We reserve the right to refuse or cancel any order where:

The product is unavailable
There is a pricing error
Fraud or unauthorised activity is suspected
We reasonably suspect commercial resale

We may not be able to cancel orders once accepted.

6. PRICING

All prices are listed in GBP (£).

We are not VAT registered; VAT is not charged.

Shipping costs are calculated at checkout.

We reserve the right to correct pricing errors.

7. SHIPPING AND DELIVERY

Delivery times are estimates only.

We are not responsible for delays caused by carriers or circumstances beyond our control.

Risk in the goods passes to you when the goods are delivered to the address provided.

Ownership passes once full payment is received.

Customs, Duties and Taxes (International Orders)

All international orders are shipped on a Delivered Duties Unpaid (DDU) basis.

This means that any import duties, taxes (including VAT), customs fees, or handling charges imposed by the destination country are the responsibility of the customer. These charges are determined by local customs authorities and must be paid directly to the carrier or customs office before delivery.

We do not have control over these charges and are unable to estimate their amount. Please contact your local customs office for further information prior to placing your order.

If customs charges are refused and the shipment is returned to us, any return shipping costs or fees incurred may be deducted from any refund issued.

8. RETURNS AND REFUNDS

Returns are governed by our Refund Policy available at:

Under the Consumer Contracts Regulations 2013, you may cancel within 14 days of receiving your order.

Return shipping costs are the responsibility of the customer unless the item is faulty or incorrect.

We reserve the right to reduce refunds where goods have been handled beyond what is necessary to inspect them.

Packaging opened for verification as described in Section 3 does not constitute a fault.

Minor cosmetic or manufacturing variations are not faults.

9. VERIFICATION, CONDITION ACCEPTANCE & CHARGEBACK POLICY

Due to the collectible nature of our products, certain items may be opened strictly for character verification, photography, or quality control purposes as described in Section 3.

By completing a purchase on our website, you expressly acknowledge and agree that:

You understand and accept that outer packaging may have been carefully opened for verification or inspection purposes.
You understand and accept that minor transit, storage, or shelf marks to outer packaging are normal and do not constitute a defect.
You agree that such packaging conditions do not render the item “not as described,” “used,” or “damaged” for the purposes of payment disputes or chargebacks.
Any claim that contradicts the disclosures clearly stated in these Terms and on the product listing may be considered a misuse of buyer protection mechanisms.

Before initiating any payment dispute or chargeback, you agree to contact us directly at info@secretgardencollectibles.com to allow us the opportunity to resolve the matter.

We reserve the right to:

Provide payment processors with copies of these Terms and product disclosures in response to disputes;
Dispute chargebacks where product condition is consistent with our published descriptions;
Refuse future sales to customers who initiate abusive or fraudulent chargebacks.

Nothing in this section limits your statutory rights under UK consumer law.

10. INTELLECTUAL PROPERTY

All website content is owned by or licensed to Secret Garden Collectibles and protected under UK intellectual property law.

Unauthorised use is prohibited.

11. DISCLAIMER

Nothing in these Terms excludes or limits your statutory rights under UK law.

Except as required by law, products and Services are provided “as is” and “as available.”

We do not guarantee uninterrupted website availability.

12. LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes liability for:

Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Breach of statutory consumer rights
Any liability that cannot legally be excluded

To the fullest extent permitted by law, we shall not be liable for:

Indirect or consequential losses
Loss of profit or revenue
Loss arising from misuse of products
Damage resulting from failure to follow age guidance

Our total liability shall not exceed the amount paid for the product in question.

13. FORCE MAJEURE

We are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to transport disruption, supplier failure, strikes, or governmental actions.
